Data Protection

We, Maschinen u. Konstruktion GmbH, thank you for visiting our website and for your interest in our company and services. Protecting your privacy during processing is a major concern for us. Therefore, your personal data will be processed only in accordance with the provisions of German data protection law. We want you to feel secure when visiting our website.

Personal Data

Personal data refers to information that relates to the personal or factual circumstances of an identified or identifiable natural person. This includes details such as name, address, email, and phone number. The legal foundations of data protection can be found in the Federal Data Protection Act (BDSG), the EU General Data Protection Regulation (EU-GDPR, from May 25, 2018), and the Telemedia Act (TMG).

Generally, the use of our site does not require the provision of personal data. However, for the use of certain services on our site, different regulations may apply. These will be separately explained below and will inform you specifically about the nature, scope, and purpose of the collection, use, and processing of personal data.

Cookies

Our website uses so-called cookies to make our online presence more user-friendly, effective, and secure. For example, cookies help speed up navigation on our platform. They also enable us to measure metrics such as the frequency of page views and general navigation patterns.

Cookies are small text files placed on your computer system. They do not harm your computer and do not contain viruses. Some of these cookies are transferred from our server to your computer system, typically as "session cookies." Session cookies are automatically deleted from your hard drive when your browser session ends. Other cookies remain on your computer system and allow us to recognize your system on your next visit (known as persistent cookies).

You can reject cookies at any time if your browser allows it. However, please note that if you do so, you may not be able to fully utilize all functions of our website.

The help function in the menu bar of most web browsers explains how to prevent your browser from accepting new cookies, how to be notified when you receive a new cookie, and how to disable all cookies. Similar functions for Flash cookies, which are used by browser add-ons, can be managed by changing the settings of the browser add-on or through the website of the browser add-on manufacturer.

Active Components

Our websites use some active components such as JavaScript, Java applets, or ActiveX controls. You can disable these features through your internet browser settings.

Specifically, the following data is collected:

  • Requesting Host Address (IP Address)

  • Name of the Retrieved File
  • HTTP Status Code
  • Amount of Data Transferred
  • Website from Which You Visited Us (Referrer URL)

These anonymous data are stored separately from any personal data you may provide, ensuring that no conclusions can be drawn about any specific individual. They are only disclosed to third parties if legally required or if a court order mandates such disclosure. There is no transfer of data for commercial or non-commercial purposes.

We reserve the right to review these data retroactively if we become aware of specific indications of unlawful use.

Online Job Applications

Your application data are collected and processed electronically for the purpose of managing the application process. If your application results in the conclusion of an employment contract, your submitted data may be stored in your personnel file for the purposes of standard organizational and administrative processes, in accordance with the relevant legal regulations.

The deletion of the data you have submitted will occur automatically two months after the notification of your application rejection. This does not apply if longer storage is required due to legal obligations (such as the duty of proof under the General Equal Treatment Act) or if you have explicitly consented to extended storage in our applicant database.

Service: Matomo (formerly Piwik) - Self-Hosted Web Analytics
We use the Matomo service on our websites. This service is operated on our own servers. The purpose is to statistically analyze user access to our websites to identify issues, peak loads, resource needs, and other optimization potentials. The use of Matomo represents a legitimate interest under Art. 6 (1) (f) of the GDPR (General Data Protection Regulation).

Matomo processes data such as the time, location, and frequency of a website visit, including the IP address. The IP address is anonymized during this process, ensuring that website visitors remain anonymous to us. The data generated by Matomo is not shared with third parties.

Use and Disclosure of Personal Data

When you commission us to provide a service, your personal data will be used only to the extent necessary for the performance of the contract (e.g., for processing information requests or brochure orders). This includes, in particular, the transfer of your data to partners responsible for your request, transport companies, credit institutions, or other service providers involved in the delivery of the service or contract fulfillment.

Beyond this, personal data will not be disclosed, especially not sold to third parties.

Exceptions include situations where we are legally obligated to disclose customer accounts and personal data, or where such disclosure is necessary to enforce our terms and conditions or other agreements, or to protect our rights and the rights of our customers and third parties. This may include situations such as attacks on our network infrastructure or legal or criminal investigations. This includes data exchanges with companies specializing in the prevention and minimization of abuse and credit card fraud. It is explicitly stated that no data will be shared with these companies for commercial use that contradicts this privacy policy.

Our employees and the service providers we engage are, of course, required to maintain confidentiality and adhere to the provisions of the Federal Data Protection Act (BDSG).

They are also required to handle the information in accordance with this privacy policy and German data protection laws.
If these subcontractors are data processors under § 11 BDSG (data processors under Article 28 GDPR), we have established appropriate, legally compliant contracts with them.
